The Turkish Competition Board Opens Investigation On-Demand Video Service Providers

According to reports, the Turkish competition board announced that it had begun an investigation into the nation's leading streaming services and video providers, such as Netflix, Amazon, and Disney+.

 Netflix, Disney+, Exxen, BluTV, Amazon, and Gain are all subscription-based on-demand video services that provide content like films and television shows. The Competition Board (RK) launched an investigation into these companies.

 A preliminary investigation into the businesses in question was completed, according to a statement posted on the board's website.

The board deemed the results of the preliminary inquiry into the allegation that these service providers had broken the "Law on the Protection of Competition," based on the information and documents gathered, to be "serious and sufficient."

It was determined to start an investigation into the financial integrity of the aforementioned platforms, which include both domestic and foreign behemoths like Exxen and Amazon, and Netflix.

 According to the RK, which provided the information on the probe, it would look into whether Netflix broke any laws while maintaining its dominant market position.

The investigation will look into whether Netflix broke the law by abusing its dominant position by, among other things, enforcing exclusivity clauses on producers, distributors, copyright holders, and talent members in the context of its content licensing agreements, and discriminating against talent members, including actors in original content and/or producers operating in Turkey, by favoring its original productions over those of independent producers on the platform.

The investigation will also examine whether Netflix, Disney+, Exxen, BluTV, Amazon, and Gain have engaged in anti-competitive agreements and practices, including exclusive contracts with content providers like producers and distributors or talent employees like actors, directors, and screenwriters.

 

The regulator reaffirmed that the board's investigative findings do not, in the meantime, imply that the businesses or groups of businesses under investigation have broken the law and are/will face penalties.
